The new law cancels the moratorium on Marinas.
The BOIB (Balearic White Paper) of July 2 publishes the Law for Ports of the Balearic Islands, the norm passed on June 14 by the Balearic Parliament, which regulates the legal statutes for the ports and the port and maritime installations ruled by the autonomous government. The administration of the marinas and nautical installations of the Balearic and Pitiuses Islands depend on the Autonomous Community of the Balearic Islands. Whereas the commercial ports of Palma and Alcúdia on Mallorca, and that of Mahon on Menorca and the City of Ibiza on that island, and La Savina on Formentera all belong to the state administration via the Port Authorities.
The new law cancels the moratorium for marinas which implied the suspension of permission for concessions for the construction and running of marinas and nautical installations in the Balearic and Pitiuses Islands.
According to the law, the creation of new ports will have to have the corresponding vinculating report from the competent island council and the non vinculating report from the pertinent Town Council. This means that the insular councils may oppose the construction of new ports. However, the town councils´s opinions will be heard not may not block the creation of new ports in their municipal area.
As far as the extensions to existing ports, these must have the non-vinculating report from the insular council when the increase implies over 30 per cent. That is the insular council and the town council may not block the extension of present marinas..
Finally, the law enumerates the existing ports and installations that come under the autonomous administration of the Balearic Islands.
